  • Personalized quizzes with AI-powered recommendations
  • Coordination of wedding services with partner resorts
  • Planning and coordination support for your event

3.2 Nature of Service

  • We act as intermediaries between you and resorts/vendors
  • Final service contracts are made directly with resorts
  • We do not own or operate the resorts shown on our site

3.3 Service Availability

  • Our services are primarily available in Mexico (Riviera Maya)
  • We do not guarantee uninterrupted website availability
  • We may modify or discontinue services at any time

4. Acceptable Use

4.1 Use License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for personal, non-commercial purposes related to planning your wedding.

4.2 Use Restrictions

You agree NOT to:

  • Use our services for illegal or unauthorized purposes
  • Violate local, state, national, or international laws
  • Infringe third-party intellectual property rights

7. Pricing and Payments

7.1 Packages and Pricing

  • Wedding package prices are displayed in USD
  • Prices are subject to change without notice
  • Final prices are confirmed at booking
  • Deposits and payments are made directly with resorts

7.2 Service Fees

  • Our coordination services may include fees
  • Fees will be clearly communicated before commitment
  • Paid fees are generally non-refundable

7.3 Taxes

  • Prices may not include applicable taxes
  • You are responsible for all applicable taxes
  • Taxes will be calculated at booking

8. Cancellations and Refunds

8.1 Cancellation Policy

  • Cancellations are subject to individual resort policies
  • Some fees may be non-refundable
  • Refunds may be subject to cancellation penalties
  • You must review specific policies before booking

8.2 Our Services

  • Lomas Hospitality coordination fees are generally non-refundable
  • Exceptions will be handled on a case-by-case basis
  • You must notify us of cancellations as soon as possible

8.3 Force Majeure

We are not responsible for cancellations or changes due to:

  • Natural disasters
  • Public health emergencies
  • Political or civil unrest
  • Other events beyond our reasonable control

9. Disclaimer of Warranties

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOMAS HOSPITALITY SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or use
  • Damages arising from use or inability to use our services
  • Acts or omissions of third parties (resorts, vendors)

10.2 Liability Limit

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $500 USD, WHICHEVER IS LESS.

10.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lomas Hospitality, its employees, directors, and agents from all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of third-party rights
  • Your content

You agree to submit to the exclusive jurisdiction of courts located in Cancún, Quintana Roo, Mexico to resolve any dispute related to these Terms.

14.3 Informal Resolution

Before initiating legal action, you agree to attempt to resolve the dispute informally by contacting us at weddings@lomashospitality.com for at least 30 days.

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and Lomas Hospitality regarding our services.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

No waiver by Lomas Hospitality of any term or condition shall be deemed a further or continuing waiver.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without your consent.

15.5 No Agency

No provision of these Terms creates a partnership, joint venture, employment, or agency relationship between you and Lomas Hospitality.

15.6 Survival

Provisions that by their nature should survive termination (including intellectual property, indemnification, limitation of liability) shall survive termination of these Terms.

16. Termination

16.1 By You

You may stop using our services at any time. You may request account deletion by contacting us.

16.2 By Us

We may suspend or terminate your access to our services:

  • For violation of these Terms
  • For fraudulent or illegal activity
  • If required by law
  • For any reason with 30 days' notice

16.3 Effect of Termination

Upon termination:

  • Your right to use our services ceases immediately
  • We may delete your account and content
  • Provisions that should survive remain in effect
